California medical marijuana FAQ: answers from the official program

Answers to the questions California patients ask most, based on the Medical Marijuana Identification Card Program (MMICP)'s own guidance.

Do I need a state card to use medical cannabis in California?

No. The MMIC program is voluntary, and a physician's recommendation documented in your medical records provides protection. The card mainly helps with law enforcement verification and the sales tax exemption.

Can I get my California recommendation online?

The Medical Board of California allows the required exam to be done by telehealth if it meets the standard of care. The state ID card, however, must be applied for in person at your county office.

How much does the California card cost?

Each county sets its own fee, capped at $100. Medi-Cal members pay half (no more than $50), and fees are waived for indigent patients in the County Medical Services Program.

What tax savings does the card give me?

If you show a valid state MMIC at a licensed retailer, you don't pay sales and use tax on medical cannabis products. A recommendation letter alone does not get this exemption.

How much can I possess or grow?

State law allows a patient or caregiver up to 8 ounces of dried cannabis per patient, plus up to 6 mature or 12 immature plants.
